EU Charges Meta Over Controversial “Pay or Consent” Ad Model: What It Means

Meta Platforms, the parent company of Facebook and Instagram, is facing charges from the European Commission for allegedly breaching the EU’s Digital Markets Act (DMA). This move targets Meta's recent introduction of a “pay or consent” advertising model, which has drawn criticism from privacy advocates and regulators.

Meta’s model, rolled out last November in Europe, gives users a choice: consent to data tracking in exchange for free access to Facebook and Instagram, or pay for an ad-free experience. However, the European Commission contends that this model forces users to give consent without offering a viable alternative that respects user privacy.

The European Commission’s Stance

According to the Commission, Meta’s approach violates the DMA by limiting user autonomy over personal data. EU antitrust chief Margrethe Vestager emphasized the need for options that allow users to control their data without being compelled to consent to extensive tracking. The Commission argues that users should have access to a less personalized but equivalent version of Meta's platforms without mandatory data sharing.

Meta's Response

Meta maintains that its advertising model aligns with EU regulations, citing a recent ruling from Europe’s top court. The company expressed its willingness to engage in dialogue with the European Commission to resolve the issue. A Meta spokesperson highlighted that the subscription model for ad-free access adheres to the DMA and reflects compliance with the court’s guidance.

Potential Consequences and Further Actions

The European Commission’s investigation into Meta’s compliance with the DMA must conclude by March 2025. If Meta is found guilty of breaching the DMA, it could face a fine of up to 10% of its global annual turnover.

This is Not the First Time

This is just the latest in a series of actions the EU has taken against Big Tech giants under the DMA. Just last week, the EU charged Apple for anti-competitive practices within its App Store.
