WhatsApp Threatens to End Operations in India Over Encryption Dispute
WhatsApp, the popular messaging platform owned by Meta, issued a bold statement to the Delhi High Court, asserting that it would cease operations in India if compelled to compromise its end-to-end encryption (E2E). The platform's advocate, Tejas Karia, made this declaration during a hearing regarding the challenge against Section 4 (2) of the Information Technology (IT) Rules, 2021.
The contentious rule mandates social media intermediaries, particularly messaging services like WhatsApp, to disclose the initial sender of specific messages, potentially necessitating the dismantling of E2E encryption.

Legal Battle Unfolds Advocate Karia argued that E2E encryption is a cornerstone feature that attracts users to WhatsApp. He contended that Section 4 (2) infringes upon user privacy laws enshrined in Articles 14, 19, and 21 of the Indian Constitution.
In response, the government's counsel, Kirtiman Singh, emphasized the necessity of identifying the origin of misinformation or hate speech. He stressed the importance of tracing messages back to their source, citing the need to protect against the spread of harmful content.
Global Precedence and Challenges WhatsApp's legal team highlighted that no other country, not even Brazil, imposes such requirements. They highlighted the monumental task of complying with traceability demands, given India's user base of over 400 million and the staggering volume of messages exchanged daily.
The platform expressed concerns that implementing traceability measures would compromise user privacy and weaken security. WhatsApp argued that enabling access to message contents to trace origins would necessitate storing vast amounts of data for extended periods.
Awaiting Resolution The Delhi High Court adjourned proceedings until August 14, calling for a balanced approach to the dispute. The outcome of this legal battle will have significant implications for WhatsApp's operations in India and could set a precedent for similar challenges worldwide.
