The Chinese government holds influence over ByteDance through a "golden share" in an affiliate company. This arrangement complicates any sale due to China's export regulations, which restrict the sale of software algorithms, a contentious aspect of TikTok. The platform's US operations are valued at approximately $40 billion.

Potential Acquisition by Elon Musk

One scenario under discussion involves Elon Musk's X acquiring TikTok's US operations and integrating them with his existing businesses. With over 170 million users in the United States, TikTok could enhance X's appeal to advertisers. Additionally, Musk's artificial intelligence company, xAI, might benefit from the vast data generated by TikTok.

Despite these discussions, it remains uncertain whether any formal talks have occurred between Musk, TikTok, ByteDance, or government officials regarding such a deal. Representatives for Musk did not respond to requests for comment on this matter.

Legal Challenges and Political Implications

TikTok has expressed its intention to challenge the ban legally. In a statement on April 24, 2024, they described the law as unconstitutional and vowed to contest it in court. They believe that both facts and legal principles support their case and anticipate a favourable outcome.

The geopolitical implications of this decision are significant. Splitting TikTok's US operations presents economic challenges. Former President Donald Trump expressed his desire to delay the ban to participate in negotiations aimed at preserving the app's presence in the United States.

Chinese Foreign Ministry spokesman Guo Jiakun declined to comment on the situation. A representative from ByteDance stated that the company "can't be expected to comment on pure fiction." This suggests uncertainty about whether any concrete discussions have taken place regarding a potential sale.

The ongoing deliberations reflect broader discussions on how China might engage with President-elect Donald Trump. He is anticipated to appoint Elon Musk to his administration after assuming office later this month.
