Government Implements Immediate Restrictions on the Import of Laptops, Tablets, and Personal Computers
In a recent development, the Ministry of Commerce and Industry has announced immediate restrictions on the import of laptops, tablets, and personal computers. These restrictions necessitate obtaining a valid license for importing these items.
The Scope of Restricted Items
According to the notification issued by the government, the following items fall under the category of "restricted" imports:

- Laptops
- Tablets
- All-in-one personal computers
- Ultra small form factor computers
- Servers under HSN 8741
Exceptions and Licensing Requirements
Despite being classified as restricted items, these products can still be imported, provided the importers have the necessary license for restricted imports. However, there are specific exceptions to the licensing requirements:
1. Baggage Rules
Imports under the Baggage Rules, which apply to customs checks for passengers entering or leaving India, will remain unaffected by the new restrictions. This means that individuals carrying laptops, tablets, or personal computers for personal use won't be subject to additional licensing requirements.
2. Single Imports from E-commerce Portals
An exception is made for a single laptop, tablet, all-in-one personal computer, or ultra-small form factor computer purchased from e-commerce portals through post or courier. These imports will be subject to applicable duty but won't require a separate import license.
3. Import for Research and Development Purposes
For research and development, testing, benchmarking, evaluation, repair and re-export, and product development purposes, importers can bring in 20 such items per consignment without the need for an import license. However, these items must be used exclusively for specified purposes and cannot be resold. Once the intended purpose is fulfilled, the products must either be destroyed or re-exported.
4. Re-Import of Repaired Goods
A license for restricted imports is not required for re-importing goods that were repaired abroad and are now being returned.
5. Exemption for Capital Goods
Capital goods such as laptops, tablets, all-in-one personal computers, ultra-small form factor computers, and servers are exempted from the import licensing requirements, as they are considered essential for various industries.
